Representative Cases
- Action by plaintiff against an assisted living facility and personal caretaker for a broken hip sustained after a fall while under custody of the assisted living facility. The 68 yo plaintiff with dementia fell and broke her hip after her 24 hour individual caretaker left her shift early allegedly because of behavioral problems with the plaintiff. The agency providing 24 hour care did not provide a substitute caregiver for the balance of the shift. The plaintiff fell during the gap in personal attendant care coverage. The caretaker and the facility were both named as defendants. The case settled.
- Representative of dependent adult initiated mediation to cancel lease entered into by landlord and tenants for an up to 48 year term in exchange for the provision of personal services to the landlord by the tenants. The representative claimed that the landlord either did not have the capacity to enter into the lease, or lacked capacity to enter into the lease, or the lease was unconscionable. Case settled for payment of lease termination fee, plus move-out by the tenants.
